ChatGPT jurisprudence: Strengthening justice or delivering injustice?

Jaswinder Singh's bail was rejected by the Punjab and Haryana High Court on March 27th, 2023. The accused had convictions. Justice Chitkara said that when the offense is heinous and the crime is brutal it becomes a factor in granting or refusing bail.

Surprise wouldn't usually be caused by the rationale and order to that effect. Justice Chitkara asked what is the jurisprudence on bail when the attackers assault with cruelty. Unless the judge decides to the contrary, the chances of bail in such cases are very unlikely.

The court made it clear that the trial court shouldn't consider the reference to the case as an expression of the merits. The judge said it was only intended to show a broader picture on bail. The reading of the order shows that the judge's jurisprudence was influenced by the order. That is why we are talking about it.

It is not known what the source jurisprudence of the chatGPT is. Did it look at any legal theories or random data? Is it possible for a constitutional court to deprive someone of life and liberty. Why use it if the trial court can't use it? Is it an amateur act to impress the world?

Let's begin with the basics. The company that created it is based in the US. The chatbot can develop new outputs based on its knowledge. Large language models are genorative pre- trained transformers. An LLM is a deep- learning program that can recognize, summarize, translate, predict and generate text based on knowledge gained from massive data sets.

Jinoy Jose P says that the more data the better the training is for LLMs. Openai has a huge data set and that is what makes it quick. GPT 3 is trained on 175 billion parameters A variety of texts can be created by the bot.

There is no human creativity or originality in this picture. It searches and retrieves information from public sources. Information can't be accessed behind paywall or non-web. Most publicly accessible online content is unreliable and contains misinformation.

It is expensive to have verified information. Intellectual property regulations must be followed by the chatbot. Such services will cost a lot. The risk of using public and free information is greater for serious business. GPT3's newest training data is from 2021.

The High Court order made me ask few legal questions. Same-sex marriage should be legal in India. As an artificial intelligence language model, I can provide some information and considerations regarding legalization of same-sex marriage in India. Arguments for both sides were presented. The cut-off date for knowing about the ongoing case is September 2021. It is up to the lawmakers, the courts, and the citizens of India to make a decision about same-sex marriage.

The approach was the same when it was asked if the Supreme Court of India should allow the repeal of Art 355. It gave some information.

The Supreme Court of India refused to make a decision on the matter. I wanted to know what sedition law in India was like. It was not aware that the Supreme Court has stopped the law from being applied.

I was not happy. The replies were basic and outdated. A lot of the information is on the web. It can't read premium legal analysis so it may be searching for answers. It's amusing that it has learned to stay neutral.

A few eyebrows were raised when the Supreme Court referred to common-law marriage in its judgement in D.Velusamy vs D.Patchaiammal. We don't know where the bail jurisprudence came from. The P&H High Court reference was not called for. Courts are endowed with the duty to deliver justice and should not allow themselves to be messed with.

The judiciary is not averse to new technology. The importance of artificial intelligence in justice delivery has been emphasized by the chief justice. The Supreme Court uses applications like Supreme Court Vidhik Anwaad Software (SUVAS), a translation tool, and Supreme Court portal for assistance in court efficiency to aid in reviewing case files, conducting legal research, and selecting the most pertinent material.

According to Bill Gates, the most revolutionary tech in the last fifty years has to do with ChatGPT. It has been compared to the industrial revolution. It has its own pitfalls. It could be a disaster.
